Case Result: $2.5 Million in Car v. Commercial Vehicle Crash on Highway 52
Attorney and Partner Ben Akery recently settled a lawsuit for a total of $2.5 million following years of litigation after a final pre-suit insurance offer of only $154,000.
Our client was driving on Highway 52 in Lake City, South Carolina when a company vehicle turned directly in front of her, causing a violent collision. Our client suffered severe back injuries. After several years of conservative treatment, she eventually required surgery. She then suffered additional health issues as a direct result of the crash including left lower extremity deep vein thrombosis and a pulmonary embolism. She will need to be on blood thinners for the rest of her life and cannot walk without a cane. Her career was impacted as she can now only work part-time. Our client is 44 years old.
During negotiations the insurance company was only willing to offer $154,000.00 to settle the case. Attorney Akery proceeded with filing suit in Florence County, SC, leading to depositions and additional discovery.
Initially the insurance company claimed there was only $1 million in coverage, but through a very thorough investigation and discovery it was uncovered that there was, in fact, a commercial umbrella policy that provided additional coverage.
The case went to mediation where the final settlement result was $2,478,850 for bodily injury and $21,150 in property damage for a total settlement of $2.5 million.
Patience and persistence paid off for our client. This case is an iconic example of why a seriously injured person needs an experienced and tenacious injury attorney working on their behalf.
