Negligence per se applies when the duty, as well as the expectations of what is required to meet that duty, are provided by statute. When a defendant violates a statutory duty owed to the accident victim, the first two elements of a negligence case are met. 

For example, the South Carolina DUI law provides, “It is unlawful for a person to drive a motor vehicle within this State while under the influence of alcohol to the extent that the person’s faculties to drive a motor vehicle are materially and appreciably impaired.” This law creates a duty all motorists must follow. Thus, if a driver violates DUI law, they’ve breached a duty. 

For negligence per se to apply, the accident victim must prove that:

  1. The purpose of the statute is to protect from the kind of harm the accident victim has suffered; and
  2. The accident victim is a member of the class of persons the statute is intended to protect. 

When negligence per se applies, all that is left for the accident victim to prove is that the drunk driver’s actions were the cause of the victim’s injuries and that the victim experienced damages as a result of the accident. 

Fatal DUI Accidents in Mt. Pleasant

Drunk driving accidents are much more likely to end with one or more people involved suffering fatal injuries. In fact, nearly 30 percent of all South Carolina traffic fatalities in 2020 involved a drunk driver. While this figure is generally in line with other states, far more South Carolinians are killed in drunk driving accidents when considering the state’s population. For example, according to National Highway Traffic Safety Administration, there are 5.6 alcohol-related traffic deaths per 100,000 people in South Carolina, whereas there are an average of 3.1 alcohol-related traffic deaths in the United States. That means South Carolina residents are nearly twice as likely to be killed in a DUI accident than residents of other states. 

In large part, this is due to the number of South Carolina under-age DUIs. For example, in 2019, the rate of underage alcohol-impaired driving fatalities in South Carolina was twice the rate of the national average.
